Resignation Rules in Kenya – What the Law Says
Under Kenya's Employment Act, 2007 (Section 35), the notice period required when resigning depends on how long you have worked at the company:

Always check your employment contract first. If your contract specifies a longer notice period than the Employment Act minimum, your contract takes precedence. Most Kenyan professional contracts require 1 month notice.
Should My Resignation Letter Give a Reason?
You are not legally required to give a reason for resigning in Kenya. A simple "I resign" is legally sufficient. However, giving a brief, positive reason maintains goodwill and protects your professional reputation — especially since your employer may be called for a reference in the future.
- Good reasons to mention: career growth opportunity, relocation, further studies, family reasons
- Avoid: criticizing management, listing grievances or mentioning your new employer by name
- If you have unresolved workplace issues, address them through HR channels separately
Can I Resign Immediately Without Notice in Kenya?
Yes — but only under specific circumstances recognized by the Employment Act. You can resign without notice if:
- Your employer has significantly breached your contract
- You face sexual harassment, physical assault or genuine threats to your safety
- You have a serious medical condition confirmed by a doctor

Never resign verbally and then fail to send a written letter. In Kenya, a written resignation letter is your legal record. Without it, disputes about your final pay, leave days and clearance certificate can become very complicated.
